These Terms of Service (“Terms”) govern your use of Hold'em Pitboss (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old to use the Service. The Service is intended solely for tracking private home poker games among individuals.
3. Gambling Disclaimer
Hold'em Pitboss is a record-keeping tool for private home poker games. We do not process, custody, transmit, or facilitate any wagers, payments, or transfers between users. All financial settlements between players occur outside the platform. Users are responsible for complying with all laws applicable to private gaming in their jurisdiction. The Service is not intended for use in connection with any commercial gambling operation.
4. Account & Authentication
The Service authenticates users via Google sign-in or email magic links. Phone numbers are used only as a contact channel for SMS notifications when you have verified a phone and opted in (see the SMS Notifications Program section below); they are not a sign-in method. You are responsible for safeguarding access to the email addresses and accounts associated with your authentication methods. One natural person, one account. You are responsible for activity on your account.
5. SMS Notifications Program
Program name: Hold'em Pitboss SMS Notifications.
Description: a transactional SMS program that notifies you about your private poker games on Hold'em Pitboss.
Message types: game invitations, schedule changes, cancellations, reminders, and host accept notifications.
Message frequency: varies based on your game activity.
Cost: Msg & data rates may apply, depending on your mobile carrier and plan.
How to opt in: in your profile, toggle SMS notifications on, enter your phone number, and verify the one-time code we send.
How to opt out: reply STOP to any message, toggle SMS notifications off in your profile, or remove your phone number from your profile.
Help: reply HELP to any message, or email support@holdempitboss.com.
Carriers are not liable for delayed or undelivered messages.
6. Acceptable Use
You agree not to:
- Use the Service in connection with any commercial gambling operation
- Use the Service for any unlawful purpose or in violation of applicable law
- Scrape, harvest, or programmatically extract data without our written consent
- Interfere with or disrupt the Service or its infrastructure
- Attempt to access accounts, data, or systems you are not authorized to access
- Harass, abuse, or harm other users
- Upload content that is illegal, infringing, or harmful
7. User Content
You retain ownership of game data, player records, notes, and other content you create in the Service (“User Content”). You grant Hold'em Pitboss a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and process your User Content solely as necessary to provide the Service to you and the people you invite.
8. Service Availability
The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, or that defects will be corrected. We may modify, suspend, or discontinue any part of the Service at any time.
9. Termination
You may delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, abuse the Service, or engage in conduct we reasonably determine to be harmful to other users or to Hold'em Pitboss.
10. Disclaimers & Limitation of Liability
To the fullest extent permitted by applicable law, Hold'em Pitboss disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, in no event shall Hold'em Pitboss be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our aggregate liability for any claim related to the Service shall not exceed one hundred U.S. dollars (US$100).
Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, or any liability that cannot be limited or excluded under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Hold'em Pitboss from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.
12. Modifications to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-product notice. The “Last updated” date at the top of this page reflects the current version. Continued use after the effective date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Hawaii, United States, without regard to its conflict-of-laws principles.
14. Dispute Resolution
Before bringing any formal dispute, you agree to contact us at support@holdempitboss.com and attempt to resolve the matter informally. Either party may bring an individual claim in small claims court for qualifying disputes. You agree that any dispute will be resolved on an individual basis and not as part of a class action, consolidated action, or representative proceeding.
